Judge dismisses expelled BOKA members urgent application

High Court Judge Boipuso Makhwe has dismissed an urgent application by some disgruntled members of Botswana Karate Association (BOKA) seeking a stay of execution.
Judge Makhwe said the matter was not urgent and dismissed the application with costs. The court had previously ruled in favour of the current executive led by Sensei Mpho Bakwadi declaring the interim committee led by Sensei Keorapetse Mogopodi illegal and unconstitutional.
The aggrieved members are however challenging the ruling. Appearing before court to challenge the urgent application, BOKA attorney Maatla Ratshee said the applicants believe the ruling by Judge Makhwe was a misdirected judgement and did not guarantee urgency.
He said they were only aggrieved by decision of the High Court thus making bare unsubstantiated allegations. He said it was a self created urgency and court could not intervene.
She said the applicants sat for 12 days and did nothing but emerged from slumber and wanted a determination to be made abruptly. He urged court to collapse the application as applicants didn't approach court with necessary dispatch.
He said there was no harm but just bare allegations bankrupt of merit and pitiful failure on the side of applicants. ENDS
